HANDYMEN Annual Home Care Plan + Service Agreement
Service Provider. HandymenLocal.com is a division of Exterior Home Improvements (EHI). “HANDYMEN” includes HandymenLocal.com and EHI as the service provider.
1. Annual Plan, Fee and Included Labor
The Annual Home Care Plan costs $198 for one enrolled residence. It includes two scheduled HANDYMEN service visits during the plan year, with up to two hours of included HANDYMEN labor at each visit, for a maximum of four included labor hours during the plan year. Four hours at the regular $75 hourly rate would be $300, creating a potential labor savings of $102 when all included time is used.
2. Plan Term and Expiration
The plan begins on the date this Agreement is signed and expires one year after that signing date. Unused visits or included labor expire at the end of the plan term, have no cash value, and do not roll over.
3. One Plan Per Residence
Only one Annual Home Care Plan may be purchased for a residence during any 12-month period. A customer, owner, tenant, household member, or other person may not purchase another plan for the same residence to obtain additional discounted service time.
4. First Visit and Payment
The appointment being booked with this Agreement is the member’s first scheduled plan visit. The $198 annual plan fee must be paid when HANDYMEN arrives for the first appointment and before any work begins. Payment activates the Annual Home Care Plan and the included first visit. No online payment is collected by this website.
5. Included Work
Plan visits are treated like normal HANDYMEN visits. Included plan labor may be used for ordinary handyman repairs, maintenance, installation, adjustment, assembly, and similar work HANDYMEN is willing and legally able to perform. Unsafe work, work outside HANDYMEN’s normal scope, or work requiring a specialty contractor may be declined.
6. Materials and Best Use of Included Time
Parts, fixtures, products, disposal charges, rentals, specialty supplies, and other materials are not included. To get the most value from included labor time, the member should have the correct replacement parts, fixtures, hardware, products, and materials at the residence and ready before HANDYMEN arrives. Time reasonably spent locating, obtaining, transporting, loading, or delivering materials is billable and may reduce the practical amount of hands-on work completed during the visit.
7. Additional Time and Work
Included labor is limited to two hours per plan visit and four hours total during the plan year. Additional authorized work or labor beyond remaining included time is billed under HANDYMEN’s regular service terms and rates.
8. No Combining Discounts or Offers
The Annual Home Care Plan price, included labor, and member benefits may not be combined with senior discounts, coupons, promotional discounts, special offers, or any other HANDYMEN/EHI discount or promotional program.
9. Authorized Work Only
The client is responsible only for services, labor, materials, fees, or additional work requested or authorized by the client. Additional work beyond the original request must be approved in a documented form such as text message, email, written change authorization, or another electronic record.
10. Regular Hourly Rate and Billable Time
Unless covered by remaining plan labor, HANDYMEN services are billed at $75.00 per hour unless a different price is specifically agreed to in writing. For on-site handyman work, billing begins upon arrival and ends after tools are put away and cleanup is completed. Setup, cleanup, and applicable material-acquisition time are billable. A handyman helper, when needed and authorized, is $35.00 per hour.
11. Materials
The client is responsible for material costs unless otherwise stated in writing. Client-supplied materials are not warranted by HANDYMEN. Additional labor caused by missing, incorrect, defective, or unsuitable client-supplied materials is billable when authorized.
12. Payment Terms
The $198 Annual Home Care Plan fee is due upon arrival at the first scheduled plan visit and must be paid before HANDYMEN begins work. Additional authorized hourly labor, materials, and other charges are due when the applicable service is completed unless another arrangement is documented in writing. Payment for completed work must be made before HANDYMEN returns for additional work.
13. Late Payment and Collection
Any unpaid balance may incur a late fee of 1% per month beginning 10 days after the payment due date. To the extent permitted by law, the client is responsible for reasonable collection costs, including attorney fees, court costs, and lien filing fees.
14. Scheduling and Delays
An appointment is a scheduled arrival/start time, not a guarantee that all requested work will be completed within the included time. HANDYMEN may adjust arrival times or reschedule because of prior-job overruns, weather, emergencies, material delays, traffic, illness, or other conditions outside reasonable control.
15. Hidden, Concealed and Unforeseen Conditions
HANDYMEN is not responsible for hidden damage, structural defects, rot, water damage, insects, mold, concealed electrical or plumbing conditions, undocumented modifications, code violations, hazardous materials, or other conditions not reasonably visible before work begins.
16. Permits, Utility Marking and Underground Items
If permits are required and HANDYMEN is required to obtain them, permit fees and related time/cost are additional unless specifically included in writing. Third-party utility markings are not a warranty that all underground or concealed items are accurately located. To the extent permitted by law, HANDYMEN is not liable for damage to underground utilities, sprinkler or irrigation lines, cables, pipes, drains, private utility lines, or other underground or concealed items that are unmarked, incorrectly marked, privately installed, unknown, or otherwise not reasonably identifiable before work begins.
17. Property Conditions and Client Responsibilities
The client will provide a safe and reasonably accessible work area, adequate utilities, reasonable parking/access, control of pets and hazards, and accurate information reasonably needed to perform the service.
18. Right to Stop Work
HANDYMEN may stop work if payment is not made when due, conditions are unsafe, access is denied, required approvals are unavailable, this Agreement is materially violated, or unforeseen conditions make continued work unreasonable or unsafe.
19. Cancellation / No-Show
The client may cancel or reschedule without a service fee by providing at least 24 hours’ notice before the scheduled appointment. Less than 24 hours’ notice, a no-show, or failure to provide reasonable access may result in a $75 service fee.
20. Liability Limitation
To the extent permitted by law, HANDYMEN is not liable for indirect, incidental, special, or consequential damages arising from the services or conditions outside HANDYMEN’s reasonable control.
21. Private Membership Relationship
This Agreement includes and incorporates the EHI Private Membership relationship for purposes of receiving services. This single signed Annual Home Care Plan + Service Agreement governs plan enrollment and the first plan service appointment without requiring a separate ordinary HANDYMEN Service Agreement for that same appointment.
22. Private Dispute Resolution and Binding Arbitration
Disputes arising from or relating to membership, requested services, or this Agreement will be resolved through private binding arbitration to the extent permitted by law. The arbitrator shall be selected from a list of qualified, neutral arbitrators designated by EHI, with the member provided a reasonable opportunity to select from that designated list. Except where prohibited by law, the parties waive trial by judge or jury.
23. Entire Agreement and Written Changes
This Agreement, the electronic booking record, and documented written changes form the parties’ agreement for the Annual Home Care Plan and first scheduled plan visit. No verbal agreement modifies them.
24. Electronic Signature and Transactional Communications
By signing electronically or in writing, the member intends to be bound by this Agreement. Transactional appointment confirmations, scheduling messages, and reminders may be sent using the contact information provided. Marketing communications require separate consent.
